Justices of the Peace are court officiants that many people choose to use for minor legal issues or because they do not want to a minister to conduct their wedding ceremonies. Justices of the peace have different roles around the country. In some states, they are judges that are appointed by higher ups in the state government. In other states, though, justices of the peace are elected officials. Although one does not technically have to attend law school to become a justice of the peace, it is standard practice now for them to have some legal training because they have to be familiar with the community’s laws, rules, and regulations concerning issues like marriage, divorce, representation, and settlements. Using a justice of the peace instead of a minister is common amongst homosexual couples in states that allow same sex marriages and civil unions because many ministers refuse to conduct the wedding ceremonies. Using a justice of the peace is also common for those who are facing small trials because they may have broken minor laws that do not need a full court with a judge and jury. For instance, justices of the peace are often officiants at traffic courts because they can oversee the cases without going through a whole trial. They frequently allow people to bargain for lesser crimes so that they do not have to face stiff penalties. Since justices of the peace are often not full judges, many people feel that less intimidate going before them to discuss a legal issue.
