Appeal Attorney Terminology

The justice system in the United States is set up in a three tiered model. Appeals court is the second level of the court system and some lawyers and law firms specialize in providing legal and attorney assistance in this particular area. Usually if a case reaches the appeals stage the charges are quite serious, such as felony cases like rape and murder. Cases with the death penalty are automatically entitled to an appeal, while in other cases a motion must be submitted to start the appeals process. Below are some common terms for appeal attorneys.

  • Original Jurisdiction – The first level of the American court system. This is where the original crime the accused is charge with took place, and therefore that court system has original jurisdiction. In this trial the accused is provided with a defense lawyer and the solicitors for the prosecution provides for a prosecutor.
  • Juvenile Court – Juvenile courts operate on a two tiered system, a court of original jurisdiction and a court of appeals. Some law firms specialize in juvenile cases and criminal law in regards to juveniles. Also, a juvenile record may be able to be expunged once the juvenile becomes of age, given that the charges against the juvenile have been resolved.
  • Appeals Court – The second stage of the court system. If the legal team of the defense or prosecution disagrees with the ruling of the court of original jurisdiction, a second trail may commence at the appeals court.
  • Supreme Court – Court of the highest level in the United States. Trials that have not reached satisfactory conclusions in the previous court levels are resolved here. Solicitors brings cases in front of the Supreme court justices.
