Divorce Terms for People Who Never Thought They'd Need Them

No one who gets married plans on getting a divorce. Divorces are painful, sometimes ugly, affairs that can devastate a family and traumatize children. And not only is divorce emotionally grueling, but it can also be an expensive and confusing journey through the legal system. Most first time divorcees are ill equipped to deal with lawyers, courts and the other trappings of this unpleasant life circumstance. If you're beginning this process, here are some terms you and your family should be familiar with.

  • Alimony - A set amount of money given from a higher earning spouse to a lower earning spouse. This sum is separate from child support.
  • Annulment - Annulment doesn't just dissolve a marriage, it declares the whole marriage null and void from the onset. The Roman Catholic Church annuls marriages that it does not consider valid due to religious reasons.
  • Arbitration - Some couples forgo the use of lawyers for their divorce and use a neutral third party arbitrator to decide issues like child custody, support and property settlements.
  • Custody - This term can be confusing because it has two meanings. Physical custody refers to a person’s right to have their child in their home. Legal custody focuses on a parent’s right to make decisions about the child's upbringing.
  • Paralegal - A professional who works with a lawyer helping prepare documents and insure compliance. Paralegals work closely with clients while helping the lawyer to prepare his or her case.
  • Separation - Some couples who choose to remain married on paper, but maintain different households, can file for separation. A separation order does not dissolve the marriage, but allows the spouses to file for child support or alimony.
