Process Server Terms to Know

A process server is a professional that is more than just a messenger or courier, they are trained agents that deliver or serve legal documents to parties involved in civil court proceedings including a subpoena, divorce papers and other court files and documents. A process server should be familiar with the laws of your state and or county that govern process serving. Here are some terms you should know before hiring a process server.

  • Service of Process - This is the process whereupon legal documents including subpoena and divorce documents are delivered to the intended party a their home or place of work and must be delivered by a third party not affiliated with the court proceedings.
  • Affidavit of Service - This is the proof that a process server has delivered court files and documents to the intended recipient. The process server must have this affidavit signed by a notary agent in order for it to be admissible in court.
  • Skip Trace - This is how a process server researches, investigates and locates difficult to find people through gathering public files and court documents to trying and identify their location.
  • Surveillance - Often a process server will go undercover and follow someone in their private, daily lives and watch them to determine their daily patterns to identify the best time to serve the intended party with court papers
  • Locate People - If a process server needs to do to extra measures to locate someone, there will likely be an additional charge. This includes services like skip trace and surveillance that are additional services that support the successful delivery of case files and documents.

These might be for a subpoena, divorce documents or court appearance. The process server is an agent or messenger who works for lawyers. Acting as a courier, they deliver these documents so that the recipients have a legal obligation to respond. In most places, if there is no proof that the people got the files, they don’t have to appear in court. This means that the agent often has to work hard to locate the recipient. A large part of the reason why you might hire a process server is to find one of the people involved in a case. Because so many places require confirmation that the documents have been received, these professionals are almost like undercover detectives. They will search for the person you need. They will trace their every move. This might mean they use surveillance tactics or even investigate a person’s lifestyle to find them. Like a private eye, a server needs the full support of their clients to be successful. If you need to deliver a subpoena for a civil or other hearing, consider hiring a server. They will help you find the person you are looking for. If you ever meet a person who asks you your name and then hands you an envelope and says “You’ve been served,” you just met a process server and are probably holding a subpoena.
