A process server is a professional that is more than just a messenger or courier, they are trained agents that deliver or serve legal documents to parties involved in civil court proceedings including a subpoena, divorce papers and other court files and documents. A process server should be familiar with the laws of your state and or county that govern process serving. Here are some terms you should know before hiring a process server.

  • Service of Process - This is the process whereupon legal documents including subpoena and divorce documents are delivered to the intended party a their home or place of work and must be delivered by a third party not affiliated with the court proceedings.
  • Affidavit of Service - This is the proof that a process server has delivered court files and documents to the intended recipient. The process server must have this affidavit signed by a notary agent in order for it to be admissible in court.
  • Skip Trace - This is how a process server researches, investigates and locates difficult to find people through gathering public files and court documents to trying and identify their location.
  • Surveillance - Often a process server will go undercover and follow someone in their private, daily lives and watch them to determine their daily patterns to identify the best time to serve the intended party with court papers
  • Locate People - If a process server needs to do to extra measures to locate someone, there will likely be an additional charge. This includes services like skip trace and surveillance that are additional services that support the successful delivery of case files and documents.
