Tort Law:A civil wrong, involving cases where someone’s behavior cases someone else’s pain and suffering. It’ not always a direct illegal act, but rather causes a person harm indirectly. Anyone suffering a loss may bring a claim in tort, with most criminal cases brought by the state.

Negligence:Failure to exercise care someone else in a similar situation would do. In tort law, this refers to harm caused by carelessness rather than intentional harm. The basis of this term assumes that people should take into account the potential harm they may cause others before acting on impulses or manufacturing products.

Tortious Interference: In tort law, this involves cases where a person intentionally damages the plaintiff’s business relationships. There are two types: one is specific to contractual relationships and one is specific to business relationships or activities.

Breach of Warranty: When a company goes back on its warranty promises. There are three types of breaches: express warranty, implied warranty of merchantability and implied warranty of fitness for a purpose.

Intentional Infliction of Emotional Distress: Known as IIED for short, this tort claim for intentional conduct results in extreme emotional distress, with some courts replacing the word “emotional” with “mental.” Also known as tort of outrage.

Assumption of Risk: A defense tactic in tort law where the plaintiff is barred from recovery against the negligent party if the defendant can show the plaintiff knowingly took on the risks as part of the dangerous activity or product being spoken about. There are two types of risk: primary assumption or risk and secondary assumption of risk.
